TERMS AND CONDITIONS

§ 1. GENERAL

The following general terms and conditions apply to all orders placed by customers (hereinafter referred to as “you”), whether personally or on behalf of an entity (“you”) and Studio Christian Ruess (“Company / Container Love / containerlove.art“, concerning your access to and use of Container Love Shop: https://containerlove.art/shop/.
By using Container Love and/or placing an order, you agree to be bound by the terms and conditions set out herein (the ”Terms”). Please make sure you have read and understood the Terms before placing your order.
The information provided on Container Love is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, if you have accepted access to the Company from other locations, you do it on your own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.
The inclusion of any products or services on containerlove.art at a particular time does not imply or warrant that these products or services will be available at any time. We reserve the right to discontinue any product at any time. We also reserve the right to amend these Terms from time to time without prior notice to you. The version of the Terms that will apply to your order will be those on containerlove.art at the time you place your order.
§ 2. INTELLECTUAL PROPERTY RIGHTS
Except as expressly provided in these Terms, no part of Container Love may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission. We reserve all rights not expressly granted to you in containerlove.art.
§ 3. PURCHASE, PAYMENT CONDITIONS AND DELIVERY
The prices displayed at containerlove.art does include an international delivery fee but not the statutory Value Added Tax (VAT) for Germany which will be add during the CheckOut process. The delivery charge for each order will be the same, regardless of the size or weight of your order. The cost for each delivery method is clearly indicated during the check-out process.
The ordering options available to you are via containerlove.art. Once you have placed your order, if you have supplied us with your email address, you will receive an email confirmation. If for any reason we are unable to fulfill your order, we will let you know at the earliest opportunity. If we have already received payment for the order, we will attempt to refund the applicable amount using the same method used to make the payment. If, for any reason, alternative arrangements are necessary we will notify you via email.
At Container Love’s Shop you can pay for your goods with the following options: Paypal, Credit Card (Stripe), SEPA Direct Debit or Sofort. When using any of the described payment methods, the Company reserves the right to check the validity of the account, that there are enough funds to cover the purchase sum and validate the billing address details of the purchaser. The applicable amount will immediately be charged. Container Love reserves the right to deny any purchase.
You will receive to your email address entered on your purchase the legally required invoice in the shipping confirmation email plus a confirmation of your payment once it has been received.
Container Love exercises the utmost diligence in accepting and processing orders and will endeavor to deliver your order in accordance with your purchase. Though we aim to deliver within the communicated time frame, delivery may take longer due to unexpected events.
Once you have placed your order you will receive an email confirmation with your expected delivery details. If your order does not arrive within the expected time frame please contact us at hello@containerlove.art including your order number to provide you with further information.
§ 4. WITHDRAWAL OF ORDER AND RETURNS
You may cancel or return your order from the date of your purchase until 30 days after the receipt date of the ordered items. Depending on the status of your order you might receive a total or partial refund based on the following conditions:
As Container Love’s Shop offers products that are only produced by demand, for a total refund you must cancel your order as fast as possible (from the date of your purchase until before it has been manufactured). To request the cancellation of your order please contact us at hello@containerlove.art as soon as possible after your purchase.
If the cancellation is still possible you will receive a full refund which will include the standard delivery cost. If you choose to keep certain items from your order and proceed with a partial cancellation, the delivery cost will not be refunded.
If your order has been already produced but not shipped, you will only receive a partial refund discounting the administrative and production costs. The refund may be processed up to 30 days days and will include delivery costs to the same payment method used when placing your order.
If your order has been already shipped the cancellation will not be possible. You can still return your product up to 30 days from the shipping date and only if they are returned in the same condition they were in when delivered. This means the items should not have been damaged or soiled. In these cases, the return costs are at the expense of the customer due to their personal decision of not wanting the product. § 5. LIABILITY
Nothing in these Terms shall exclude or limit Container Love liability with regard to any matter for which it would be unlawful for us to limit or exclude our liability. We do not seek to exclude liability for fraudulent misrepresentation by us or our employees or agents. If we breach these Terms we shall only be liable for losses which are a reasonably foreseeable consequence of such breach.
Container Love is not responsible for indirect losses which are a side effect of the main loss or damage; or for failure to deliver the goods or to meet any of our other obligations under these Terms where such failure is due to an event that is beyond our reasonable control, which includes but is not limited to fire, flood, storm, riot, civil disturbance, war, nuclear accident and terrorist activity. Our maximum liability to you for any loss or damage arising in connection with your order on containerlove.art shall be limited to the total price of your order.
§ 6. PRODUCTS AND COLORS
We and our manufacturing partners make a great effort to accurately display and deliver the attributes of our products, including composition and colors. Keep in consideration that the colors you see in our shop also depend on your computer system, and we cannot guarantee that your computer will accurately display such colors.
§ 7. GUARANTEE
If there are defects in the goods you have purchased, Container Love abides by all statutory guarantee regulations. If you have a complaint regarding obvious material or manufacturing faults in goods that we have supplied, including damage incurred in transit, please let us know by getting in contact immediately to hello@containerlove.art to provide you with a solution.
§ 8. ASSIGNMENT AND SEVERANCE
Container Love reserves the right to assign or pledge to third parties any claim(s) for payment which have arisen in connection with the delivery of goods. If any part of these Terms is disallowed or found to be ineffective by any court or regulator, the other Terms shall continue to apply.
